Was kostet mich die Beurkundung?)".

Notarial fees, together with court costs, are standardised nationwide and are, in principle, exhaustively regulated by the GNotKG, the Act on Costs in Non-contentious Proceedings for Courts and Notaries. This consolidation of court and notarial fees within a single Act is no coincidence; rather, it underscores the fact that notaries, like the courts, perform a public function within the scope of the duties entrusted to them; in this context, we also refer to ‘notarial official duties’. The GNotKG therefore imposes obligations on and limits notaries: where required, notaries must charge and collect notarial fees – and where not required, they may not do so. Notaries – as, of course, courts – are prohibited from entering into agreements with the parties regarding fees.
Notarial fees are therefore calculated in accordance with the GNotKG.
Notarial fees consist of fees and disbursements.
The amount of the disbursements corresponds to the costs actually incurred by the notary.
With a few exceptions, the amount of the fees is always based on the value of the matter in question. Therefore, for example, the purchase price of a property or the amount of a land charge has a direct impact on the fees: they decrease or increase in line with the value. It does not matter how labour-intensive or complex, how short or protracted, or how high-risk the procedure actually is. At first glance, this seems unfair: shouldn’t a notary be paid in line with the effort involved? In fact, however, this is not the intention of the legislature. Notaries do not provide services but perform public functions in the field of preventive administration of justice; in a broader sense, they form part of public services. That sounds rather grand. But bear in mind that notaries must also act within the scope of their sovereign duties. It is in the public interest that neither judges nor notaries can refuse to handle proceedings because they fear too much work. In concrete terms, this means that even citizens with modest means can enjoy notarial services without restriction; and yes: this is precisely what is financed by the fees, which may be high in individual cases, for those who have more.
The amount of the notary fees can therefore be determined from the GNotKG once it has been clarified what the subject matter of the notarial service is and what the respective value of the matter is. We are also happy to provide information on the expected costs using specific examples (for instance, “I want to draw up a will and have assets of approximately €50,000”).

Allocation of the purchase price between land and building
For the tax depreciation of a building, it is often necessary to allocate the purchase price between the land and the building. Determining these values and assessing the tax implications are not among the duties of the notary. We do not carry out any calculations and do not review calculations submitted to us.
The tax authorities provide a calculation tool with instructions for this purpose: purchase price allocation tool of the Federal Ministry of Finance (in German). The standard land value (Bodenrichtwert) required for the calculation is available from the land value portal: BORIS-BW (in German).
The parties may agree on an allocation of the purchase price in the purchase agreement. If you wish to do so, please let us know the values before the draft contract is prepared. The notary cannot assess whether, or to what extent, the tax office will accept the allocation. We recommend agreeing the allocation with your tax adviser in advance.
